Fairfax County Motorcycle Accidents
Motorcycle accidents, more so than car accidents, often result in severe injuries to the rider, and sometimes death. A motorcycle rider, aside from a helmet, has no protection when a collision occurs with a car or truck. Many motorcycle riders are not merely "dumped" onto the roadway, but often thrown from the bike, causing serious injuries.
Motorcycle riders have to be careful of negligent motorists when on the road, and car drivers have to watch where they are going. All users of the highway must share the road.
Investigating Negligence in Motorcycle Crashes
Virginia law places a very high burden on plaintiffs, or those who are bringing personal injury cases against negligent parties. Virginia practices a law called contributory negligence. This old legal doctrine means that if you, the person bringing the claim, is even 1% percent responsible for an accident, then you cannot recover. This is very different from the laws in most other states, some of which compare or apportion negligence.
This same legal doctrine holds true in a wrongful death case. If you are attempting to pursue a wrongful death claim on behalf of a deceased loved on, then your loved one must not have even been 1% responsible for the crash that claimed his or her life.
If you have lost a loved one in a motor vehicle collision, you need to speak to an experienced Fairfax Personal Injury Attorney right away, because time is of the essence. The longer you wait, the higher the risk that vital information and evidence can be lost.
Wrongful Death Claims in Fairfax County
After you have lost a loved in a motorcycle accident, in order to pursue a wrongful death claim, an state has to be created. This estate is different from what most personal think of when they hear that term, as this is solely for the purposes of pursuing wrongful death litigation (Virginia Code 64.2-454).
Sometimes, a family member is appointed as the "Personal Representative" of the Estate, and in certain situations, it is easier (and less stressful for the family) to have an independent Personal Representative appointed, such as a retired attorney.
