How Wrongful Death Claims Work in Fairfax County, VAPedestrian Killed in Crash on Rte 28

Virginia’s wrongful death statute lets a family seek compensation for losses that follow a death caused by another person’s wrongful act. Recoverable damages can include sorrow and mental anguish, the loss of the person’s income, services, and companionship, and reasonable medical and funeral costs. If the conduct of the other party was willful or wanton, punitive damages may also be available, though state law generally limits them.

A family does not file the claim directly. The personal representative of the estate brings it on behalf of the surviving beneficiaries, who can include a spouse, children, and, depending on who survives, parents or other relatives. The filing deadline is generally two years from the date of death, so appointing that representative is typically the first practical step.

In these cases, a wrongful death attorney can help a family gather income records, bills, and estate paperwork to build a strong case.
