What Damages Are Available in a Fatal Accident Case in Fairfax County, VA?Fatal Midday Crash on Rte 29 Kills Motorcyclist in Fair Lakes, VA

Virginia allows families to recover economic damages, such as medical and funeral expenses and lost financial support, as well as non-economic damages like grief and loss of companionship.

If another driver’s negligence caused a fatal accident in Fairfax County, the surviving family may pursue these damages through a wrongful death claim.

A personal representative can file a wrongful death claim on behalf of eligible family members, including a spouse, children, or parents. In commercial truck cases, the trucking company may share liability with the driver, affecting the potential recovery.

To pursue a wrongful death claim after a crash involving a commercial vehicle requires a careful review of multiple evidence sources. For instance, truck driver logs, vehicle maintenance records, dashcam or black box data, and the findings of the police investigation.

Virginia applies a contributory negligence standard, that means a claim’s outcome can change if the deceased shared any fault. An experienced Fairfax wrongful death lawyer can assess how that standard applies to the specific facts of a case and what options realistically exist for the family.
