Can Passengers Seek Compensation After a Serious Crash in Virginia?20-Year-Old Driver Killed, Passenger Critically Hurt in SUV Crash on Center Dr

Yes, in Virginia, a passenger injured in a car crash can generally seek compensation for their injuries, regardless of who was at fault. Because passengers typically bear no responsibility for causing an accident, they have a straightforward path to pursuing a claim against the at-fault driver’s insurance policy.

These victims may be eligible to seek compensation for a wide range of damages, such as emergency medical treatment, hospitalization, surgery, rehabilitation costs, and lost income during recovery. When injuries are life-threatening, long-term care and ongoing medical expenses may also factor into the claim. Virginia law allows injured passengers to pursue compensation for both economic and non-economic damages, including pain and suffering.

Virginia follows a contributory negligence rule, which is one of the strictest standards in the country. Under this rule, if an injured person is found even partially at fault for the accident, they may be barred from recovering compensation entirely. For passengers, this standard is rarely an issue since they generally have no control over how the vehicle is operated. However, every case involves different facts, and a car accident attorney can help clarify how Virginia’s laws apply to a specific situation.

If you or someone you know suffered serious injuries as a passenger in a Virginia crash, our team can help explain what legal options may be available.
