Who Is Liable When a Driver Hits a VDOT Worker in Richmond, VA?Three Hospitalized After Crash on I-95 Near Lombardy St in Richmond, VA

When a driver strikes a VDOT safety service patrol vehicle on an active highway work zone, liability most often falls on the driver of the striking vehicle. Virginia law imposes heightened duties on motorists approaching active work zones, including requirements to slow down and move over for vehicles displaying amber warning lights. If a driver fails to comply with these rules and injures a roadside worker may face both civil liability and criminal traffic charges under Virginia’s Move Over Law.

Roadside workers struck by passing vehicles can suffer catastrophic injuries. High-speed impacts in highway work zones frequently result in traumatic brain injuries, spinal trauma, multiple fractures, and in the most severe cases, permanent disability. People that are hurt may be eligible to seek compensation for medical expenses, lost income, and the long-term physical and financial toll of their injuries.

A car accident attorney can play a critical role in work zone crash cases, where liability is usually disputed and multiple parties may be involved. An attorney can gather dashcam footage, review trooper reports, obtain black box data from the striking vehicle, and build a case that accounts for all contributing factors. For a VDOT worker hurt on the job, legal representation can help navigate the overlap between a workers’ compensation claim and a separate personal injury action against the at-fault driver.

In Virginia, the statute of limitations for a personal injury claim is generally two years from the date of the crash. However, injured government workers like VDOT safety service patrol employees may face additional procedural requirements depending on how their claim is structured, particularly if it involves both an employer workers’ compensation filing and a civil action against a private driver. Missing either deadline can significantly limit the recovery available.
