Depending on the circumstances of each case, a claim may recover medical expenses, lost income, pain and suffering, and other damages recognized under Maryland law.

One of the first things that victims need to understand is that Maryland applies a strict contributory negligence rule. This rule can prevent recovery if an injured person is found to have contributed to their own injury.

For example, if a jury determined that the other driver was primarily responsible but also found that the injured person was even slightly negligent, that finding could bar recovery entirely. Because of this strict standard, evidence that shows exactly how the crash occurred can be especially significant in a Maryland injury claim.

When several people are injured in the same accident, each person’s claim is generally evaluated based on their own injuries, losses, and evidence. Medical records, photographs, witness accounts, vehicle damage, and available video can help establish what happened and document the resulting losses.

Many crash victims rely on a Maryland car accident lawyer for guidance during the claim process. A lawyer can review the available evidence alongside insurance information to determine which claims and potential sources of recovery may apply to each case.
