What Rights Do Injured Passengers Have After a Crash in Springfield, VA?One Killed, Two Hurt in Crash on Old Keene Mill Rd in Springfield, VA

Passengers hurt in a single-vehicle crash have legal rights that can be misunderstood. In Virginia, an injured passenger is very rarely considered at fault for the crash, which means they may be able to file a claim against the driver’s liability insurance regardless of their relationship to that driver.

This applies even when the at-fault driver is a friend or family member, since any compensation would come from the insurance policy, not the individual personally.

Virginia requires all drivers to carry a minimum of $30,000 in bodily injury liability coverage per person and $60,000 per crash. When passenger injuries are severe, those minimums may not cover the full cost of treatment and recovery.

In cases where the at-fault driver carried insufficient coverage, passengers may have additional options depending on their own insurance policy, including underinsured motorist coverage.

The consequences for passengers in high-impact crashes can be severe. Traumatic brain injuries, spinal damage, broken bones, and internal trauma are among the injuries that may not be fully apparent until days after a wreck.

When one injury is life-threatening, the road to recovery is long and the associated costs  can accumulate well beyond what people anticipate.

Virginia operates under a contributory negligence standard, which is stricter than most states. If a passenger is found to have contributed in any way to the crash, they may be barred from recovering compensation entirely. This makes early legal guidance especially valuable.

A car accident attorney can assess the facts and help protect a passenger’s ability to pursue a claim before any statements are made that could complicate that process.
